Proposal prohibits certain types of advertising at sporting events

Bill 2479/26 creates measures to protect children and adolescents from excessive exposure to advertising, propaganda, and communication related to fixed-odds betting (bets) during major sporting events. The text also provides for the strengthening of digital protection and mental health policies, as well as minimum standards for responsible advertising in the betting sector.

During sporting broadcasts with free access or with relevant audiences of children and adolescents, the following advertising is prohibited:

  • use language, aesthetics, or communication directed at children;
  • associate gambling with personal success, financial independence, or easy enrichment;
  • utilize child characters, animated characters, animations, or resources associated with the child universe;
  • promote gambling as a form of social belonging, youth affirmation, or demonstration of maturity;
  • associate gambling with sports performance, personal merit, or healthy lifestyle;
  • utilize digital influencers, athletes, or personalities whose primary audience consists of minors under 18 years of age;
  • present bets in a challenge, mission, progressive reward, gamification or similar format with the potential to attract young and adolescent audiences;
  • encourage impulsive or immediate bets during live sporting events.

All advertising of bets displayed during sporting broadcasts must clearly and audibly state that it is prohibited for those under 18 years of age, warn about the risks of addiction and debt, and provide guidance on responsible practice. It should also indicate public support channels related to mental health and compulsive gambling, when available.

In addition, the text establishes obligations for betting platforms and operators with accessible mechanisms, such as reinforced age verification, parental control, and voluntary limitation of use and spending.

In addition to other applicable sanctions, non-compliance with the law may result in a warning, fine, suspension of the advertising material, temporary restriction of advertising, and suspension of promotional campaigns.

Campaigns and accountability
The executive branch may launch nationwide awareness campaigns on the risks of compulsive gambling, digital protection for children and adolescents, financial education, mental health related to gaming and betting, and prevention of youth indebtedness.

The project is by Deputy Duda Ramos (Pode-RR). In the justification, the parliamentarian states that "it is necessary to ensure that the sporting environment is not used as a gateway for the early normalization of betting behavior among young people."

Next steps
The proposal will be reviewed, inconclusive natureby the commissions of Communication; of Consumer Protection; of Social Security, Assistance, Childhood, Adolescence and Family; of Finance and Taxation; and of Constitution and Justice and of Citizenship.

To become law, the text must be approved by the Chamber and the Senate.
