Bill 3164/26 ensures that people affected by burns have access to all available means for physical, aesthetic, psychological, educational, and professional recovery and rehabilitation.
The proposal by Deputy Laura Carneiro (PSD-RJ) provides for comprehensive assistance within the Unified Health System (SUS) and supplementary health.
The project, which is under review in the Chamber of Deputies, guarantees the performance of reconstructive plastic surgery in cases where there are alterations with loss of function or aesthetics resulting from loss of function.
The proposal also ensures that people with disabilities the right to the assessment procedure for disability provided for in theLaw on Persons with Disabilities.
Legal certainty
According to Laura Carneiro, the proposal aims to guarantee greater legal certainty and effectiveness to the rights of victims. "Burns are among the main external causes of morbidity and mortality in Brazil," the parliamentarian highlights.
She cites data from the Ministry of Health that point to the occurrence of approximately 1 million accidents per year in the country, with approximately 2,500 deaths.
Laura Carneiro emphasizes that survivors often face serious physical, functional, aesthetic, and psychological sequelae, impacting self-esteem, work capacity, and social inclusion. She also notes that "there is no specific federal legislation that consolidates the rights of this population."
"The provision of care is subject to different interpretations in the SUS and in supplementary health, leading to legal disputes and delays in accessing essential treatments, especially reconstructive surgeries," the deputy stated.
Process
The project is being processed indefinitive characterand will be analyzed by the Health, Constitution and Justice, and Citizenship commissions. To become law, it must be approved by the deputies and the senators.
