The Public Prosecutor's Office of Ceará, through the 1st Public Prosecutor's Office of Acaraú, recommended last Friday (September 18th) that the City Hall preserve the vegetation during the execution of renovation and requalification works in squares and other open spaces in the municipality.The recommendationfrom the Public Prosecutor's Office of Ceará was issued after it was constatado that the municipal administration has been removing large trees during the services, in an unjustified manner.
The City Hall should refrain from removing, cutting, drastically pruning or damaging trees in squares and public spaces, especially those of greater size, age and landscape value. The exception occurs when preservation is technically infeasible, which must be proven and documented through a technical report. In addition, when removal is inevitable, the appropriate environmental agency must be duly authorized.
Another recommendation from the Public Prosecutor's Office is that, in the phase of developing requalification projects, the City Hall should promote popular participation and adopt the guideline of preserving vegetation, conditioning interventions to the maintenance of the existing landscape, as well as preparing an inventory and individualized evaluation report of the species before any work. These projects should also include management techniques compatible with environmental preservation.
In the already executed works where trees were removed, the Municipality must carry out compensatory planting in a public area, with an equal or greater number of specimens removed, prioritizing native or urban-suitable species. Finally, the municipal administration must forward information to the Prosecutor's Office about ongoing or planned works.
Recommendation
It is an extrajudicial instrument issued by the Public Prosecutor's Office, which suggests the adoption of certain measures by public or private entities to correct irregularities or improve performance in the public interest. The recommendation serves to persuade the recipient to perform or refrain from performing certain acts. The objective is to improve public services and of public relevance, correct conduct and prevent new irregularities, more quickly and without involving the Judiciary.
