The Public Prosecutor's Office of the Republic in Pará (PR/PA) is the unit of the Federal Public Ministry (MPF) in the state. The Public Prosecutors of the Republic exercise their functions in the cases in progress in the federal courts and also in the actions filed before the Regional Electoral Court, through the Regional Electoral Prosecutor's Office.
Headquartered in Belém, it also has decentralized units in other Paraense municipalities where there are federal courts, and the Public Prosecutor's Offices of the Republic are located in Altamira, Marabá and Santarém.
The Federal Public Ministry is part of the Brazilian Public Ministry, as stipulated in the Federal Constitution of 1988. The Brazilian Public Ministry is made up of the Public Ministries of the States and the Public Ministry of the Union, which includes the Federal Public Ministry (MPF), the Labor Public Ministry (MPT), the Military Public Ministry (MPM) and the Public Ministry of the Federal District and Territories (MPDFT).
The MPF, like the Brazilian Public Ministry, is not part of any of the three branches (Executive, Legislative and Judicial) and has functional independence guaranteed by the Federal Constitution.
The MPF is responsible for defending the inalienable social and individual rights, the legal order and the democratic regime. The body is responsible for the oversight of the application of laws, the defense of public property and for ensuring that public authorities respect the rights guaranteed in the Constitution.
The Public Ministry (MPF) operates in cases of federal interest, either on its own initiative or through provocation, throughout Brazil and in cooperation with other countries. The action can be judicial, as a law enforcer, civil and criminal, but it can also be extrajudicial, when it acts through recommendations and promotes agreements through Conduct Adjustment Terms (TACs). The institution files lawsuits in the name of society, offers criminal complaints and must be heard in all ongoing cases in the Federal Justice that involve relevant public interest, even if it is not a party to the lawsuit.
Interventions in all phases of the electoral process are the responsibility of the Public Ministry (MPF), which acts with the State Public Ministries, which address the first instance Electoral Justice. Therefore, the Electoral Public Ministry is linked to the MPF.
The instruments of action of the Public Ministry are provided for in Article 129 of the Federal Constitution, within the chapter "Of essential functions to Justice". The functions and duties of the MPF are contained in Law Complementary No. 75/1993.
