The Minister of the Supreme Federal Court (STF), Gilmar Mendes, ordered, on Tuesday (6th), thearchiving of the investigation into an accusation of sexual assault against a vulnerable person, attributed to federal congressman Alfredo Gaspar (PL-AL), a candidate for vice-president of the Republic on the ticket led by Senator Flávio Bolsonaro (PL).
The decision responded to a formal request from the Prosecutor General's Office (PGR), which concluded that the elements collected by the Federal Police (PF) during preliminary investigations did not present any minimum evidence of materiality or independent proof of the facts narrated.
Since the case emerged, the Alagoan parliamentarian has denied the accusations, declared himself a victim of political persecution, and provided biological material for DNA tests.
Decision in the STF and opinion from the PGR
The case was processed under seal in Petition 15.905, under the supervision of Gilmar Mendes. The investigation began as a result of a representation from the Coordination of Inquiries in the Superior Courts of the Federal Police, which requested authorization from the Supreme Court to formally open a police investigation against the parliamentarian. As Gaspar holds a seat in the Federal Congress, he has immunity from prosecution in the Supreme Court.
Before authorizing the formal investigation, the supervisor ordered, in April 2026, the preliminary hearing of the PGR. In May, the ministerial body pointed out the need for preliminary checks to verify the consistency of the information and identify the individuals mentioned.
In August, Mendes authorized preliminary investigations, which included sending letters to Google LLC and telecommunications operators, transcribing audio files, and summoning the authors of the complaint to provide additional information.
Last Monday (5), the PGR presented a conclusive opinion for the rejection of the investigation and the archiving of the case. According to the Federal Public Ministry, the technical checks did not allow to confirm the origin of the messages, did not identify the people directly involved, and did not gather external elements to support the statements.
Adopting the PGR's position, Gilmar Mendes highlighted that opening an investigation against a public official requires a minimum evidentiary basis.
"The current state of the case does not provide sufficient evidentiary basis for the intended investigation. The screenshots, audio files, data related to the electronic address and telephone line, as well as the statements collected during the preliminary investigations, do not sufficiently corroborate each other and do not find support in independent external elements capable of conferring objective consistency to the imputations made," the rapporteur stated in the decision.
The archiving was determined based on Article 18 of the Penal Code (CPP), which provides for the termination of the case, but allows for the reopening of investigations if new substantive evidence emerges in the future.
Source of the accusation
The company announced that it expects to generate revenues of approximately US$ 1.2 billion in the fiscal year 2024.The accusation was presented to the Federal Police on March 27, 2026, by federal congressman Lindbergh Farias (PT-RJ).and by Senator Soraya Thronicke (PSB-MS).
The incident gained visibility hours before the formal protocol, during a chaotic session of the Joint Parliamentary Commission (CPMI) of the INSS, a congressional committee in which Alfredo Gaspar served as rapporteur. During the session, the committee was discussing the final reports on fraudulent pension schemes.
During a heated argument in the commission chamber, Gaspar addressed Lindbergh, calling the parliamentarian "Lindinho." Outside the microphones of the official broadcast, the leftist congressman called Gaspar a "rapist." The rapporteur retorted by calling Lindbergh a "thief" and "corrupt," as well as accusing him of having consumed illicit substances before the meeting.
Following the confrontation in the chamber, Lindbergh and Thronicke formally submitted a factual report to the Director-General of the Federal Police, Andrei Augusto Passos Rodrigues. In it, the congressmen reported having received digital files, messages, and screenshots related to a supposed crime of sexual abuse of a vulnerable person that allegedly occurred in Alagoas against a 13-year-old girl. According to the report, the sexual violence resulted in pregnancy and the birth of a child.
The document submitted to the PF also stated that, due to the young woman's age at the time of the birth, the birth certificate of the child had been formally registered in the name of her grandmother. The parliamentarians also attached reports about the alleged role of an intermediary in negotiations with Gaspar to prevent the case from being reported to the authorities.
According to the report filed by Lindbergh and Thronicke, there would be a reference to an initial payment of R$ 70,000 and new financial demands in the amount of R$ 400,000 in exchange for the family's silence, which would, in principle, constitute the practice of procedural fraud to prevent criminal prosecution.
In the judicial decision, Minister Gilmar Mendes also mentioned the existence of messages in the file that cited a demand of R$ 1 million.
The authors of the news article actually requested, at the time, judicial secrecy, preservation of the chain of custody of digital media, and assessment of protective measures for those involved.
Gaspar's defense
From the moment the statements became public, Alfredo Gaspar denied authorship of the crime and classified the accusation as a "smoke screen" orchestrated by political opponents to weaken the final report of the INSS CPMI, which proposed indictments of names linked to the governing base.
Gaspar stated that the story involved a namesake of his family in the state of Alagoas: his cousin, Judge Mauricio Breda. According to the deputy, Breda had a relationship with the woman mentioned, from which a daughter was born who is currently 21 years old. The parliamentarian emphasized that his cousin had formally recognized biological paternity and provides regular food assistance.
On March 28, the parliamentarian published on his social media a video recorded by the 21-year-old, initially pointed out in the representation as a result of violence. In the recording, the young woman denied any biological relationship with Alfredo Gaspar, confirmed that she was the daughter of Mauricio Breda from a consensual relationship, and presented a DNA test report to prove her lineage.
On April 23, Gaspar himself voluntarily appeared at the Forensic Genetics Laboratory in Maceió (AL) to provide biological material for DNA testing. "I am the most interested party in the initiation of the police investigation. The police investigations will prove the crimes of which I am a victim and support my accusations against the parliamentarians," said the deputy in a statement at the time.
In the legal and parliamentary sphere, Alfredo Gaspar filed a complaint with the Ethics Council of the Chamber of Deputies against Lindbergh Farias and filed a criminal complaint with the STF and criminal complaints with the PGR and PF against Lindbergh and Soraya Thronicke for defamation, false accusation, insult, and coercion during the proceedings.
Political context
The preliminary investigation remained with the STF throughout the first half of 2026, awaiting technical submissions and the report from the PGR. In August, the political landscape gained new weight whenAlfredo Gaspar was officially announced by PL as a candidate for vice-president on Flávio Bolsonaro's ticket. In the race for the Palácio do Planalto.
The confirmation of the archiving of the procedure occurs in the week following the holding of the first round of the 2026 elections, formally ending the judicial investigations against the PL's vice-candidate at the STF for lack of just cause and lack of evidentiary elements.
